Why Personal Training Contracts Require Attention

Personal training packages often involve significant upfront costs — $1,000 to $5,000 or more. The contracts are typically drafted by the gym or training company and heavily favor the provider. Understanding the terms before paying can save you from expensive regrets.

Session Packages and Pricing

  • Package structure: How many sessions are included, and what is the per-session rate?
  • Session duration: Are sessions 30, 45, or 60 minutes? Confirm this is the actual training time, not including warmup or cool-down
  • Session frequency: Is there a required minimum number of sessions per week?
  • Expiration date: This is the biggest trap — many packages expire after 60-90 days regardless of whether you used all sessions. If you paid for 20 sessions but only used 12 before the deadline, you may lose the remaining 8

Cancellation and Refund Terms

  • Session cancellation: How much notice is required to cancel an individual session? (Typically 12-24 hours)
  • Late cancellation penalty: Is the session forfeited, or do you pay a reduced fee?
  • Package cancellation: Can you cancel the entire package and receive a prorated refund for unused sessions?
  • Cooling-off period: Some states require a cancellation window for personal service contracts (check your state's consumer protection laws)
  • Trainer departure: What happens if your assigned trainer leaves the gym? Can you get a refund if you are unsatisfied with the replacement?

Liability Waiver

Virtually every personal training contract includes a liability waiver. Understand what you are signing:

  • Assumption of risk: You acknowledge that exercise carries inherent physical risks
  • Waiver of negligence claims: Many waivers attempt to release the trainer and gym from liability even for their negligence. Courts in many states do not enforce these provisions for gross negligence
  • Medical clearance: Are you required to provide medical clearance? If you have pre-existing conditions, this is important for both parties
  • Injury protocol: What happens if you are injured during a session? Is there a documented injury response procedure?

What to Negotiate

  • Extended expiration: Push for 6-12 months instead of 60-90 days
  • Session freezing: The ability to pause your package for vacations, illness, or injury
  • Pro-rated refund right: If you are dissatisfied after a reasonable trial period (3-5 sessions), can you receive a refund for remaining sessions?
  • Trainer selection: The right to switch trainers without penalty
